Official Contest Rules


1.1. The Cider Shake Contest (the “Contest”) is run by Tieton Cider Works, LLC., 619 W J St, Yakima, WA 98902 (the “Sponsor”).

1.2. The Contest includes the following stages (1) online registration (Entry Form), including recipe, and video submission (as defined below) starting at 12:00 am (PST) on November 1st, 2015, and closing at Midnight (PST) on December 31st, 2015; (2) judging of the recipes and selection of the top twenty-two (22) entrants as determined by YouTube’s thumbs-up approval system and in conjunction with Tieton Cider Works concluding at Midnight (PST) on December 31st, 2015 (3) the announcement of Winners on January 29th, 2016 on www.cidershake.com, (4) prizes to be sent out on or around February 8th, 2016 and no later than February 20th, 2016.


2.1. To enter the Contest you must be a lawful permanent resident or citizen of the United States, including the District of Columbia and 21 years of age or older. Contest is void for residents of Colorado, Puerto Rico, U.S. territories, possessions, and commonwealths, and wherever else prohibited or restricted by law, regulation, rule, or other directive. The Contest, and any website pages and advertisements related thereto, is intended for viewing only in the United States. You are not eligible to participate in the Contest if you are not located within the United States. The Contest is governed by U.S. law and is subject to all applicable local, state and federal laws and regulations.

2.2. The Contest is not open to employees, owners, officers, members, or directors or members of any of those persons’ households or immediate families (spouses, parents, siblings, children and each of their respective spouses) of: (a) Sponsor or a parent, subsidiary, or affiliated company of Sponsor; (b) Back Bar USA or a parent, subsidiary, or affiliated company of Back Bar USA; (c) any state alcohol commission, (d) a licensed alcoholic beverage retailer or wholesaler, or a parent, subsidiary, affiliate, or advertising or promotional agency of such a retailer or wholesaler.



3.2. By entering the Contest and submitting and Entry Form (defined below), contestants agree and consent to be bound by these Official Contest Rules and the decisions of the Sponsor, which shall be final, and to waive any right to claim ambiguity in the Contest or these Official Contest Rules.

3.3. Contestants must submit contact information, a complete recipe, a picture of your cocktail, and a video not to exceed 10 minutes in length to www.cidershake.com (“Entry Form”). Such submissions by contestants are referred to herein as an “Entry” or “Entries.” Contestants may submit up to four recipes only. Recipes must feature one Sponsor cider product per entry. You will need to specify one base Sponsor product per cocktail on the entry form. Multiple submissions must complete a new Entry Form for each cocktail submission. Contestants are limited to only submitting one recipe per Sponsor product (in short, this means contestants who enter this contest multiple times must use different Sponsor ciders for each entry), defined as follows:

3.3.1. Wild Washington, Apricot, Cherry, Yakima Dry Hopped, Blossom Nectar, Tieton Dry, Spice Route, Pumpkin, Cranberry, Sparkling Perry, Cidermaker’s Reserve, Frost, and Wind.

3.4. To submit an entry on the Competition Website a contestant must (i) complete the online Entry Form including their first and last name, date of birth, city of residence, email address, and telephone number, (ii) submit a cocktail recipe including the name of their Recipe, ingredients, measurements, servings, time required to prepare, step-by-step preparation instructions, and a photo of the cocktail. Only participants who have provided all such information will be eligible, (iii) submit a video NOT to exceed ten minutes in length demonstrating themselves creating their custom cider cocktail. PLEASE NOTE: By filling out an ENTRY FORM, you herby give the Sponsor complete control and authority to promote your entry, cider cocktail, and video on any/all advertising, marketing, social media, electronic or print mediums as they see fit. Should you take issue or disagree with any of the above, your exclusive remedy should be not to participate in this contest.


4.1. Contestants may submit up to four (4) Entries per person as outlined in Rule 3.3 and are subject to disqualification if they do not meet the requirements outlined in Rule 3.3.

4.2. Recipes must comply with the following Recipe submission guidelines (the “Recipe Submission Guidelines”):

4.2.1. Recipes must include at least one (1) Tieton Cider Works cider as a major ingredient (at least 20% of total cocktail) from the following brands: Wild Washington, Apricot, Cherry, Yakima Dry Hopped, Blossom Nectar, Tieton Dry, Spice Route, Pumpkin, Cranberry, Sparkling Perry, Cidermaker’s Reserve, Frost, and Wind. Rule 3.3.1

4.2.2. Other spirits or beverages may be used as secondary (or complementary) ingredients.

4.2.3. Recipes must be original (an original Recipe is the product of one's own mind and is not a copy or imitation of a Recipe published elsewhere) and entrant must own any/all necessary right, title and interest in and to the Recipe, including copyright. Any copyright infringements against the contestant will result in disqualification.

4.2.4. Recipes may not include more than ten (10) ingredients, including fruit juices, syrups, drops, or dashes. In addition, Recipes may include an additional spray of citrus fruit zest or an aromatic spray over the drink if specified as a garnish.

4.2.5. Recipe must not include house made ingredients in any form with the exception of simple syrup using 1 part water, 1 part sugar. No other ingredients shall be added to the simple syrup recipe or any variations to the measures.

4.2.6. Recipes must contain a minimum of one (1) oz. of a Sponsor Product.

4.2.7. Recipe submission must include the following: Recipe title; Complete list of ingredients; Method including exact measurements for each ingredient and the number of servings (non-alcoholic ingredients for your Recipe must be sourced locally); Garnish instructions; Glassware choice; Name of cocktail; A photograph (PNG, GIF, JPG or JPEG only. Maximum file size: 10MB); Birthdate of contestant. The winner must be twenty-one (21) years of age or over.

4.2.8. Excluded from the contest will be Recipe submissions which: Have been submitted to another competition and/or won a prize; Have been published or publicized to the best of the entrant’s knowledge (i.e., Recipe must not appear in major cookbooks, magazines etc.); Include inappropriate words or drink titles (ex: rude, lurid, sexual words or words associated with narcotics or motor vehicles) as determined by the Sponsor in their sole discretion; or Violate the rights of any other parties, including without limitation, any intellectual property, trade secret or other proprietary right of any third parties. Recipes submissions which are offensive, defamatory, discriminatory, obscene, libelous, reflect poorly on Sponsor products or be inappropriate for use in advertising or for promotional publicity purposes as determined by the Sponsor in their sole discretion.

4.3. All Entries must be presented in English.

4.4. Entries must be original in that the contestant must be its author and creator, or have obtained all necessary rights and authorizations to use it under the terms provided for in these rules. The content of either must not violate any laws or any third-party rights.

4.5. Entries may not invade the privacy of a person, i.e., contain his/her name, image, biographical information, likeness, photograph, or voice, without having obtained the consent of that person, who must be at least 21 years of age.

4.6. Entries may not have inappropriate content, including but not limited to explicitly sexual, offensive, harassing, discriminatory, defamatory, abusive, malicious, or hateful content. Moreover, Entries may not: (a) have suggestive images or language or encourage any illegal activity, (b) include any commercial content, and (c) include any element protected by copyright.

4.7. If Sponsor has reason to believe that any Entry consists of protected content that is not properly authorized, or if the content does not meet the conditions and requirements of these rules, Sponsor has full discretion to refuse to consider the Entry in whole or in part. No notice or explanation will be given to contestants regarding the consideration, non-consideration, broadcast or non-broadcast of their material.


5.1. The top twenty-two (22) Recipes (“Winners”) as determined by Sponsor will be selected on December 31st, 2015 and posted on www.cidershake.com by January 29th, 2016. Selection of winning Recipes will be in the sole and exclusive discretion of Sponsor after verifying social media tallies, along with adherence to Contest Rules. No ineligible participants may win.

5.2. Winners will be notified by telephone on or around January 25, 2016 at the telephone number provided by the contestant on the Entry Form. Communication will be entered into only with selected Winners, NO family members or third party representatives.

5.3. Before being declared a Winner, each Contestant must abide by the following:

5.3.1. Complete and return to Sponsor by the deadline specified in the documents a written Declaration of Compliance & Release (the “Declaration and Release” by January 27th, 2016), which, among other things: (a) confirms compliance with these Official Competition Rules; (b) releases the Competition Entities from any liability in connection with this Competition including, without limitation participation in the Tieton Cider Works upcoming publication, “Cider Spiraling” (name subject to change without notification); and (c) grants the Sponsor a worldwide, royalty free, perpetual and unlimited non-exclusive license to edit, adapt, copyright, publish, use, reproduce or distribute the Recipe in any form or manner or media, whether now known or hereafter devised, including, without limitation in print, radio, television and Internet, for any lawful purpose including, without limitation, for the purposes of advertising and promoting Sponsor and its products and services, without further notice or compensation to the Winner(s); and (d) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Competition and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet.

5.4. In the event the Sponsor and/or its agent leaves a phone message for a Winner, the Winner must contact the Sponsor by phone at the number provided in the phone message. Inability to reach selected Winners by phone may result in disqualification and selection of an alternate Winner with the next highest score (thumbs-ups as described in 6.1.) as determined by the Sponsor and who will be subject to disqualification in the same manner, provided sufficient time remains.


6.1. This contest winners are determined solely through the usage of YouTube’s criteria of determining success (or as YouTube describes “likes” – or thumbs-ups). Utilizing YouTube’s video sharing properties, Contestants will be judged by the number of “thumbs-ups” recorded from (PST) midnight beginning on November 1st, 2015 and concluding on (PST) midnight on December 31st, 2015. Should a dispute arise ass to the number of thumbs-ups recorded at the conclusion of this Contest, it is the sole right of Cider Shake’s officials and Tieton Cider Works to make the most accurate determination of rightful Winners. You herby resolve or give away any legal claims connected with any portion of this judging system by entering this Contest (or filling out an Entry Form). Furthermore, your confirmed entrance into this Contest confirms you fully understand the Criteria associated with judging this contest and are completely and without any legal recourse as it relates to results or the determination of winning Entries or Contestants. Should you have any issue with the Judging Criteria as described above, your exclusive remedy will be to NOT enter this contest.

6.2. Odds of being selected as the Winner are subject to a variety of items (including, but not limited to): (i) number of Entries into the Contest (limit is 4). (ii) timing of your Submission and Entry Form in tandem with social media savvy and presence. (iii) ensuring all criteria as described within the Program Rules is followed closely.

6.3. Before being declared a Winner, each potential winner will be required to sign and return to Sponsor, within the time period specified, a Declaration and Release Form which will release the Competition Entities from any liability in connection with the Prize (as defined below) and which will grant the Sponsor all right, title and interest in and to your Cocktail(s) for use by Sponsor in any manner or media whether now known or hereafter devised anywhere in the world in perpetuity for any purpose including without limitation for the purposes of advertising and trade. Your completed “Declaration and Release” Form is due by January 27th, 2016.

6.4. Sponsor reserves the right to disqualify any Winner and rescind any prize for any violation of these Official Rules or as required by state or federal law, rule, regulation, or other directive. Sponsor also reserves the right to disqualify any Winner, rescind or revoke any prize, and/or choose a different winner should any winner fail to live up to the winner’s obligations as set forth in these Official Contest Rules that are a condition to entering the Contest or winning a prize.


7.0.1 Chance of Winning/Odds: The chances of winning the prizes outlined below is enhanced by the number of entrants into the contest (maximum is 4 entries). Expected entries are between 700 – 1000. Furthermore, active participation via social media will also enhance your chances of winning.

7.1. The 1st Place/Grand Prize is two thousand dollars ($2,000.00). In addition, the 2nd Place/Runner-up Prize is one thousand dollars ($1,000.00). Prizes will be delivered via check within one month of competition ending. In addition, one hundred dollars ($100) will be awarded to 20 additional contestants. The judging criteria is clearly outlined above. This prizes will also be delivered via check within one month of competition ending. Absolutely no other prizes and/or prize monies will be awarded.

7.2. Title of Tieton Cider Works “Cider Shake” Champion of the Year 2015.

7.3. The Prizes must be accepted as awarded, are not transferable, and cannot be substituted or redeemed for cash or otherwise. The Sponsor reserves the right, in its sole discretion, at any time to substitute any prize (or component thereof) with another prize (or component) of equal or greater monetary value. Sponsor makes no representations or warranties with respect to any prize. No alcohol is included in any part of a prize.

7.4. All expenses not specifically identified as included in the prize are the sole responsibility of the respective prize Winner. All costs, taxes, fees, and expenses associated with any element of any prize not specifically addressed above are the sole responsibility of the respective prize Winner, including but not limited to: any transportation to find and purchase supplies or ciders,

7.5. By submitting an Entry or otherwise participating in this Contest, participants agree to the taking, use and communication of their personal information by the Sponsor and/or its authorized agents in order to manage the Contest and prizes. Except in Tennessee and where prohibited by law, a potential Winner’s entry and acceptance of a prize constitutes permission for Sponsor to use said potential Winner’s name, photograph, likeness, statements, recipe (and other entry materials), biographical information, voice, and city and state address on a worldwide basis, and in all forms of media, in perpetuity, and without any notice, payment, or compensation for any commercial or noncommercial purpose(s). Contestant further agrees at Sponsor’s request to sign an affidavit of eligibility, release, and disclaimer in a form satisfactory to Sponsor as a condition to winning any prize.

7.6. All applicable taxes (including federal, state, and local taxes) on prizes are the respective prize winners’ sole responsibility.


8.1. By submitting an Entry, the contestant thereby irrevocably grants Sponsor and its representatives all rights, title, and interest in the Entry including but not limited to copyright and trademark rights, which contestant holds or will hold in the Entry and to waive, for the benefit of Sponsor any rights that the contestant holds or will hold in the Entry. This grant includes the unconditional, worldwide, and perpetual right, without compensation, to use the Entry for the purposes of this Contest or any other purpose (including but not limited to using, reproducing, disseminating, publishing, distributing, performing in public, and/or editing the Entry) including without limitation for broadcast in various media including its websites, social media websites, Web banners, or advertising material at points of sale for promotions Sponsor’s products.

8.2. By submitting an Entry, contestants agrees that their names and places of residence may be used in association with the Entry, and declare that the Entry submitted is original, that the contestant is the sole author of the Entry or has received all necessary authorizations and rights to its use, including waivers of rights of publicity and personal privacy from anyone appearing in the video, and is not violating any law or third-party rights. By submitting an Entry, contestants further agree, upon request, to provide Sponsor and its representatives with proof of such authorizations.

8.3. By submitting an Entry, contestants acknowledge that Sponsor and its representatives assume no liability for the use, publication, and/or broadcast of the entry submitted, and contestants agree to indemnify and hold Sponsor or its representatives harmless from any trademark, copyright infringement, intellectual property, personal privacy or right of publicity claims, or other proceedings arising therefrom.

8.4. By submitting an Entry, contestants agree to release, discharge, indemnify and hold harmless Sponsor and each of its respective officers, directors, employees, representatives and agents from and against any claims, damages or liability whether arising in tort, contract, or otherwise, due to any actual or alleged injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Contest-related activity or participation in this Contest.


9.1. The Sponsor, its respective affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Contest; inability to access the Website; theft, tampering, destruction, or unauthorized access to, or alteration of entries; transactions that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any web site; printing or human or other errors; and any entries which are late, lost, incomplete, misdirected, stolen, mutilated, illegible or postage due, or any combination thereof. Participants assume all risk with regard to the creation and submission of their entries and the uploading to, downloading from, or otherwise accessing, transmitting or in any way using of any websites, including but not limited to youtube.com, facebook.com, and instagram.com, in connection with this contest. Sponsor specifically disclaims responsibility for any such damage or loss, including but not limited to viruses, spam, hacking, theft, bugs, or worms, and/or the loss or destruction of files.

9.2. Sponsor may prohibit an entrant from participating in the Contest or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or any other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives, or has violated these Official Rules. If for any reason this Contest is not capable of running as planned, including, but not limited to tampering, unauthorized intervention, fraud or any other causes beyond the reasonable control of Sponsor which corrupt in any way or affect the administration, security, fairness, integrity, fulfillment or proper conduct of the promotion, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest and select a winner from those entries received up to the cancellation/suspension date. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

Please specify “Rules Request” or “Winners’ List Request” on the front of the envelope. The Prize Winners will be available January 29, 2016 on www.cidershake.com. Requests received after January 31, 2016 will not be honored.


11.1. Website Access. Sponsor does not, in any way, guarantee that any Internet site(s) associated with this Contest, including but not limited to www.cidershake.com will be accessible or operational without interruption throughout the Contest Period or exempt from all errors.

11.2. Sponsor’s Absolute Right to Change Official Rules. Sponsor reserves the right, in its sole and absolute discretion, to change any of these Official Rules for the Contract, including but not limited to extending the period for Entries.

11.3. Sponsor’s Absolute Right to Terminate Contest. Sponsor reserves the right, at its sole discretion, to terminate, cancel, end, modify, or suspend, in whole or in part, the Contest for any or no reason. Contestants shall have no recourse in such an event nor reacquire any rights in their submitted Entries.

11.4. Dispute Resolution, Choice of Law, and Consent to Jurisdiction. This Contest and all issues arising out of it shall be governed in accordance with the laws of the State of Washington, excluding its conflicts-of-law rules. By submitting an Entry or otherwise attempting to participate in the Contest, the participant consents to settling any dispute arising under or in any way connected with these Official Rules or the Contest by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association by one or more arbitrators appointed in accordance with such Rules. The place of arbitration shall be Seattle, Washington. The substantive laws of the State of Washington, not including its conflict of law rules, shall be applied in any arbitration. Judgment may be entered upon any award in any court having jurisdiction.

11.5. Waiver. Failure by Sponsor to enforce or exercise any rights under the terms of these Official Rules shall not be deemed a waiver of such terms or of any rights.

11.6. Severability. If any provision of these Contest Official Rules is declared or judged illegal, unenforceable or void by a court of competent jurisdiction, the paragraph will be considered stricken from the Official Rules but all other provisions not affected will continue in full effect within the limits permitted by law.
